What Replaced NHR in Portugal

─────────────────────────────────────────────────

WHAT REPLACED NHR IN PORTUGAL?

─────────────────────────────────────────────────

NHR ended in 2023 after roughly a decade of operation. It was replaced by a more restrictive program, sometimes called NHR 2.0 or IFC, reserved for people with high-value or scientific/academic professions. Unlike the original program, the replacement offers no benefit on pension income at all, shifting its focus away from retirees toward working professionals.

WHAT ARE PORTUGAL'S MAIN VISA OPTIONS FOR AMERICANS?

─────────────────────────────────────────────────

The four most relevant visas for Americans are the Golden Visa, D2, D7, and D8. The D7, built mainly for people with passive income such as pensions, Social Security, or rental income, is the most popular among Americans, with a minimum income requirement around €920 a month for the main applicant. The D8 is built for digital nomads working for or running a company overseas and requires a higher minimum income.

WHAT IS THE GOLDEN VISA'S HIDDEN US TAX PROBLEM?

─────────────────────────────────────────────────

The Golden Visa's main appeal is that it does not require becoming a tax resident, as long as someone stays under roughly half the year in Portugal. In a real client case, someone who became a tax resident anyway found that their Golden Visa investment was classified by the US as a Passive Foreign Investment Company (PFIC), a designation that carries punitive tax treatment. Coordinating the visa decision with US tax implications from the start can prevent this outcome.

HOW DID PORTUGAL'S CITIZENSHIP TIMELINE CHANGE?

─────────────────────────────────────────────────

Portugal's path to citizenship changed from five years to ten within the past year, following public debate about whether five years was sufficient time to establish genuine ties to the country. A grandfathering provision protects people who had already applied under the five-year rule, though the law went through a legislative reversal after a presidential review found parts of the original change unconstitutional.

WHAT IS PORTUGAL'S SPLIT-YEAR TAX RESIDENCY RULE?

─────────────────────────────────────────────────

Portugal determines tax residency based on the date someone actually becomes a resident within the calendar year, rather than taxing the full year retroactively. Becoming a resident partway through the year, for example in August, means Portuguese tax applies only from that date forward, creating a real planning window to act on US tax advantages beforehand.
